1. ORDER CANCELLATION
If you wish to cancel an order, you must notify the Supplier immediately, preferably by telephone, quoting the order number.
If the cancellation is accepted, no additional cancellation fee will apply. If the Supplier refuses to cancel the order due to the fact that the delivery has been fully prepared and/or the order is in the process of being delivered to your location, the order cannot be cancelled. Orders already shipped will not be refunded.
If the cancellation was requested in time and the supplier has accepted the cancellation of the order, we will refund or re-credit your debit card with the full amount within 7-14 business days, including the initial delivery fee paid for the delivery of the products, if applicable.
The Supplier may cancel an order if the product is not available for any reason attributable to the Supplier. In such a case, we will notify you, if applicable, and refund any payment made.
The order placed by the user may be cancelled without any prior notice and without any subsequent obligation of either party to the other or without either party being able to claim damages from the other in the following cases:
a) Non-acceptance by the bank issuing the User’s card of the transaction, in the case of online payment;
b) Invalidation of the transaction by the card processor approved by our company, in the case of online payment;
c) The data provided by the user on the platform are incomplete and/or incorrect.
2. FORCE MAJEURE
Neither party shall be liable for the failure to perform its contractual obligations if such failure to perform on time and/or properly, in whole or in part, is due to a force majeure event. Force majeure is an unforeseeable event beyond the control of the parties which cannot be avoided.
If within 14 days from the date of its occurrence, the respective event does not cease, each party shall have the right to notify the other party of the full termination of the contract without any of them being able to claim any other damages from the other.
APPLICABLE LAW – JURISDICTION
This contract is subject to United Kingdom law. Any disputes arising between Modern Cosy Home Ltd and customers / buyers will be resolved amicably or, if this is not possible, the disputes will be resolved by the competent UK courts in the city of Corby, Northamptonshire.
